Reviewing the constitutionality of laws does not mean rewriting them. In Decision No. 12/2026, the Constitutional Council did not limit itself to striking down specific phrases, but imposed binding reservations that broadened the exceptions and added restrictions and provisions that had not been voted on by Parliament.
In the case of Islamist detainees, these interpretations must not undermine the amnesty’s effect or entrench discrimination. Justice requires fair and transparent treatment.
Respect for the Constitutional Council is essential, but so is respect for the limits of its jurisdiction and the constitutional principle of separation of powers. Reform must come through a law passed by Parliament.
